Recent Case Law

• Restoration of Status – Dhir v. Canada, 2026 FC 903: Work permit applications withdrawn on October 14, 2023, which applicants alleged was done erroneously by former counsel. First restoration applications filed within 90 days but refused because applicants were ineligible for open work permits based on their PR application. Second restoration applications filed July 31, 2024. Court found potentially misleading wording in the first refusal could not extend the mandatory 90-day period or create a substantive right. Judicial review dismissed. Read more 

• Dependent Child Sponsorship – Adeleke v. Canada, 2026 FC 905: Sponsor became a permanent resident through an economic class in 2018 but did not declare or have his daughter examined. Later sponsorship included DNA evidence, financial transfers, photographs, and a 2018 affidavit identifying her as his biological daughter. Court found IRPR 117(9)(d) applied despite paternity uncertainty and no fraudulent intent. Public policy exemption unavailable because sponsor immigrated through an economic class. IAD lacked jurisdiction to consider H&C factors. Judicial review dismissed. Read more 

• Study Permit – Chukwudi v. Canada, 2026 FC 930: Applicant accepted into a two-year aviation program with $107,575 tuition, paid 75% of tuition, and held a $21,700 GIC. Approximately $27,836 in his account was described generally as family support, but large deposits lacked identified sources or evidence linking contributors to him. Court found these funds represented about 38% of his claimed resources and their source, nature, and availability were not established. Insufficient evidence did not require an opportunity to respond. Judicial review dismissed. Read more 

• Humanitarian and Compassionate – Tufail v. Canada, 2026 FC 914: Pakistani applicant in her early 70s lived with her Canadian daughter and grandchildren after entering on a super visa in 2022. H&C application based on severe knee osteoarthritis, dependence on her daughter, family separation, BIOC, and establishment. Evidence included brief declarations, a one-sentence medical letter, and three brief supporting letters. Court found insufficient detail on daily mobility, healthcare access in Pakistan, establishment, and the effect of separation on the grandchildren. Judicial review dismissed. Read more 

• Humanitarian and Compassionate – Omowaye v. Canada, 2026 FC 916: Family relied on the principal applicant’s Canadian e-commerce business, the children’s BIOC and integration in Canada, violence and gender discrimination in Nigeria and Trinidad and Tobago, the killing of his mother in a church attack, and a psychotherapist’s report. Officer found limited evidence of business contributions, personalized risk or hardship, or effects on the children, and noted the business could operate from abroad. Psychotherapist’s report was general and identified no diagnosis or significant condition. Judicial review dismissed. Read more 

• Self-Employed Persons Class – Khan v. Canada, 2026 FC 917: PR application to open a karate studio in Mississauga refused in October 2024. Applicant sought reconsideration and separately challenged the original refusal but did not perfect that judicial review. IRCC reviewed the application, original refusal, and reconsideration request, then declined to reopen the file. Applicant’s arguments concerned only the original refusal and identified no error in the reconsideration decision. Judicial review dismissed. Read more

• Canada and the Northwest Territories Support Francophone Immigration – July 8, 2026: Canada announced approximately $860,000 for a new project to improve the retention and integration of Francophone and bilingual immigrants in the Northwest Territories through better immigration information, foreign credential recognition, employer participation, and expanded services outside Yellowknife. • Canada and Manitoba Support Francophone Immigration – July 6, 2026: Canada announced approximately $1.3 million for a project to attract and retain Francophone and bilingual newcomers in Manitoba and extended the Francophone Minority Communities Student Pilot through August 2027. • Canada Launches National Food Security Strategy – July 6, 2026: Canada announced more than $3 billion over 10 years to increase grocery competition, expand domestic food production and processing, support year-round fruit and vegetable production, and reduce regulatory barriers across the agricultural supply chain. • IRCC Updates Gaza Special Measures – July 7, 2026: IRCC updated its instructions to confirm port-of-entry facilitation and in-Canada supports for approved clients, including fee-exempt status extensions or changes, financial assistance, settlement services, Interim Federal Health Program coverage, and use of the “MOME2023” document remark. • Saskatchewan Man Convicted of Counselling Immigration Misrepresentation – July 10, 2026: Following a CBSA investigation, a Saskatoon resident received a conditional sentence, $10,000 fine, and community service after pleading guilty to counselling foreign nationals to submit false employment information and documents in immigration applications. • CBSA Lays 12 Charges in International Student Fraud Case – July 7, 2026: Two Ontario residents were charged with fraud, uttering forged documents, and counselling immigration misrepresentation after allegedly collecting approximately $126,000 from international students for tuition while providing fraudulent enrolment documents.
