- Spousal Open Work Permit and Study Permit – Rattol v. Canada, 2026 FC 1217: Applicants, spouse and child of a foreign worker, were refused for insufficient funds. - Misrepresentation – Temporary Resident Visa – Kaur v. Canada, 2026 FC 1216: Applicant’s TRV was cancelled and she was found inadmissible for misrepresentation after IRCC deemed a property valuation report fraudulent. The PFL stated only that the report had been verified as fraudulent, while GCMS notes showed the concern arose from similarities to reports in other applications. The Court found she was not given the facts underlying the concern or a fair opportunity to respond. Judicial review granted. Read more
- Work Permit – Singh v. Canada, 2026 FC 1221: Applicant, an Indian agricultural worker, sought an LMIA-based farm worker permit in BC. The officer found his economic motives could outweigh his ties to India and was not satisfied he would leave Canada. The Court found the reasons conclusory and failed to meaningfully address significant ties to India, including his spouse, children and property.
