Recent Case Law
- Misrepresentation – Study Permit – Said v. Canada, 2026 FC 1226: Applicant’s study permit was refused with a 5-year inadmissibility finding for allegedly using an undeclared representative. He stated that he prepared the application himself and a third party only paid the fee by credit card. IRCC relied on the same card being used in unrelated applications without disclosing this concern in the PFL or adequately explaining how it established undisclosed representation. Procedural fairness breached; decision unreasonable. Judicial review granted. Read more
- Spousal Sponsorship – Misrepresentation – Musembi v. Canada, 2026 FC 1241: Applicant’s inland spousal PR was refused after IRCC found his earlier TRV declared a marriage he later denied. He claimed an agency inserted the false information without his knowledge. The Court upheld the officer’s rejection of innocent misrepresentation, finding the Applicant responsible for reviewing his application before submission. The 14-day PFL response period was fair. Judicial review dismissed. Read more
- Canadian Experience Class – Garg v. Canada, 2026 FC 1242: Applicant’s CEC PR was refused after IRCC excluded her Data Administrator employment as not genuine, leaving insufficient qualifying work experience. Concerns included her lack of relevant experience, the employer’s unfinished website and conflicting business addresses in tax records. The Court found the officer reasonably assessed employment genuineness, not mandatory NOC credentials. No further PFL was required for discrepancies arising from the Applicant’s own evidence. Judicial review dismissed. Read more
- Misrepresentation – Work Permit – Permanent Residence – Xu v. Canada, 2026 FC 1236: Applicant’s work permit was refused with a 5-year inadmissibility finding after IRCC called her declared Chinese employer and reached her husband, the registered contact, who could not explain her employment and cited their children’s education as the family’s main reason for immigrating. She claimed he was only an investor, but supporting employment records were insufficient. The Court upheld reliance on the verification call, finding no duty to contact the employer’s manager or issue a further PFL. Her PR refusal followed from the inadmissibility finding. Both judicial reviews dismissed. Read more

- Ukrainian Temporary Residents – Client Experience Survey – October 7, 2026: IRCC is conducting a voluntary survey in October among randomly selected Ukrainian temporary residents in Canada, including CUAET applicants, to gather feedback on their experiences and future intentions. Read more
- Temporary Workers – October 8, 2026: IRCC updated its temporary worker eligibility and admissibility, temporary workers, and temporary resident functional guidance pages to standardize PDI titles under the Processing section. Read more
- Humanitarian and Compassionate Applications – October 6, 2026: IRCC made updates to its Program Delivery Instructions concerning consecutive or concurrent H&C applications or requests during Stage 1 processing in Canada, along with the related table of contents. Read more

- Alberta Immigrant Impact Awards – October 5, 2026: Alberta recognized 20 immigrants for their contributions to the province through professional achievements, entrepreneurship, innovation, community leadership and other fields. Recipients were selected across eight award categories and must be foreign-born permanent residents or Canadian citizens residing in Alberta. Read more
- Ontario Immigrant Nominee Program – Ontario Workforce Priority Stream – October 7, 2026: Ontario updated the Canadian work experience earnings history scoring factor under the OWP Expression of Interest (EOI) system. Registrants who earned $80,000 or more in a single year within the past five years, verified by a CRA Notice of Assessment, now receive 10 points. The change took effect October 5, 2026, and was automatically applied to existing EOIs without requiring any action from registrants. Read more
Canada Gazette Updates
- Ebola-Related Immigration Measures – October 10, 2026: The Canada Gazette published an order extending immigration restrictions affecting foreign nationals residing outside Canada in the Democratic Republic of the Congo, Uganda and South Sudan until November 27, 2026. Affected immigration documents remain suspended, and applications may continue to be processed but not finalized. The measures do not apply to individuals in Canada, and ministerial exemptions may be granted on a case-by-case basis. Read more
