Canada, 2026 FC 1107: Applicant’s second work permit application included an expired Letter of Support; designated entity’s supplemental letter confirmed continued support but was not the required IMM 5766 Letter of Support. IRCC Guidelines require a valid Letter of Support when the work permit application is received; failure to provide one was sufficient, on its own, for refusal. Judicial review dismissed. Read more

Temporary Resident Visa – Raeisi Ardali v. Canada, 2026 FC 1109: TRV refused over provenance of funds and missing transaction summaries. Officer failed to engage with evidence showing the host sister’s professional income and source of funds, or explain why it was insufficient. Unreasonable financial assessment. Mandamus – Temporary Resident Visa – Mansoursharifloo v. Canada, 2026 FC 1111: TRV remained in security screening for 900+ days after “approved pending info from partners.” Processing estimates relevant but not determinative; no evidence explaining the case-specific delay or need for extended screening. Late CV request did not justify prior years of inactivity. Mandamus granted; decision required within 60 days. Read more

Start-Up Visa Work Permit – Shoaie v. Canada, 2026 FC 1114: Application failed to establish an urgent business need for the applicant’s presence before PR finalization. Skills and anticipated contributions to the start-up ≠ urgent need for immediate work. No fairness breach where officer relied on absence of evidence supporting the applicant’s own submissions about required Canadian partnerships and connections. Judicial review dismissed. Read more

Humanitarian and Compassionate – Forcades v. Canada, 2026 FC 1117: Long-term Canadian residence and multiple work permits, but no temporary resident status. Work permit under s. 206 or 207(c)/(d) does not itself confer status; officer could negatively weigh failure to regularize status. Establishment, financial support to family, country conditions and prior risk findings reasonably assessed. Judicial review dismissed. Read more

Temporary Resident Visa – Kaur Khurana v. Canada, 2026 FC 1120: Refusal based on insufficient finances and lump-sum deposits, although bank statements identified deposit origins and extensive accountant/bank-certified asset evidence was provided. Visitors, unlike students, not statutorily required to demonstrate sufficient and available financial resources. Officer also failed to address significant family ties in India. Judicial review granted. Read more

Temporary Resident Visa – Gill v. Canada, 2026 FC 1121: While JR was pending, IRCC reopened the TRV application and invited updated evidence, apparently after mistaking leave for a merits decision. Reopening gave the applicant the same relief sought on JR, rendering the matter moot. Application dismissed. Read more

Spousal Work Permit – Kaur v. Canada, 2026 FC 1123: Refusal based on insufficient evidence of spouse’s Canadian employment in a qualifying TEER category despite closed work permit, employer letter, positive LMIA, contract, paycheques and bank records. Evidence pointed to a different conclusion and required analysis; concern over deposit regularity could not outweigh the remaining evidence without justification. Judicial review granted. Read more

Judges, Referees and Similar Officials – R186(m) – September 1, 2026: IRCC updated its work permit exemption instructions for judges, referees and similar officials, including revised eligibility requirements, examples for each category, and changes to align the guidance with the International Mobility Program’s current format, language and links. Emergency Repair Personnel – C13 – September 1, 2026: IRCC updated its C13 work permit exemption instructions for emergency repair personnel and personnel repairing out-of-warranty equipment, with minor clarifications and formatting changes to align the guidance with current standards. Read more

Protected Persons – Permanent Residence Medical Examination – September 1, 2026: IRCC updated its admissibility instructions for protected persons applying for permanent residence to reflect amendments, effective October 30, 2025, to the temporary public policy exempting certain in-Canada protected persons from the immigration medical examination requirement. Comprehensive and Progressive Agreement for Trans-Pacific Partnership (CPTPP) – September 2, 2026: IRCC updated its CPTPP instructions following the United Kingdom’s accession to the agreement, effective September 1, 2026. The revised guidance applies across CPTPP business visitors, intra-corporate transferees, investors, and professionals and technicians. Read more

Canada Gazette Updates

Ebola Border and Immigration Measures – September 5, 2026: Canada extended Ebola-related immigration restrictions until September 28, 2026. For foreign nationals outside Canada residing in the Democratic Republic of the Congo, Uganda or South Sudan, affected immigration applications may continue to be processed but cannot be finalized, while issued visas and other immigration documents remain suspended. A separate aviation order also prohibits most foreign nationals who have been in the DRC within the previous 21 days from boarding a flight to Canada. Read more
