- Temporary Resident Visa – Ghafouri v. Canada, 2026 FC 510: TRV refused based on insufficient ties to Iran, unclear source of funds, and limited travel history. The Court found the officer reasonably assessed the evidence, including reduced weight to bank statements lacking transaction history and to caregiving evidence where no plan was provided for the applicant’s mother. No procedural fairness breach arose. Judicial review dismissed. Read more
- Temporary Resident Visa – Hadian v. Canada, 2026 FC 479: TRV refused due to insufficient evidence of purpose of visit, ties to Iran, and temporary intent. The Court found the record was minimal, including incomplete and untranslated documents, with no corroborating evidence of ties. The reasons were intelligible and justified on the record. - Humanitarian and Compassionate – Hernandez Delgado v. Canada, 2026 FC 497: H&C application refused despite establishment, medical evidence, and best interests of grandchildren. The Court found the officer relied on outdated country condition evidence, failed to engage with worsening health, conducted a deficient BIOC analysis, and failed to apply a compassionate approach. - Humanitarian and Compassionate – Juarez Boyso v. Canada, 2026 FC 499: H&C application refused for lack of establishment and failure to regularize status. The Court found the officer misapprehended the applicant’s efforts to regularize status and failed to assess the depth of family relationships and the impact of removal on a reconstructed family unit. The decision was unreasonable. Judicial review granted. Read more
- Humanitarian and Compassionate – Lin v. Canada, 2026 FC 515: H&C application refused where the applicant fled an abusive relationship and lost spousal sponsorship. The Court found the officer failed to consider the immigration consequences of the abuse, minimized domestic violence, and imposed unreasonable evidentiary expectations. - Start-Up Visa – Narouni Esfahan v. Canada, 2026 FC 503: PR application refused under the Start-Up Business Class after a co-applicant identified as essential was refused. The Court found the officer correctly applied the regulatory framework requiring refusal where an essential team member is refused, regardless of subsequent changes to the team. - Humanitarian and Compassionate – Oduleye v. Canada, 2026 FC 507: H&C application refused based on insufficient establishment and hardship. The Court found the officer failed to transparently weigh factors, imposed an implicit requirement of exceptional establishment, and conducted an inadequate BIOC analysis by focusing on adaptability rather than best interests. - CBSA/RCMP Enforcement – Fraudulent Passports Seizure – April 14, 2026: RCMP charged an Ontario resident under Criminal Code s. 57(3) after CBSA officers at Toronto Pearson intercepted a commercial shipment from Nigeria containing seven fraudulent passports concealed in goods, all bearing the same photo with inconsistent identities, leading to arrest and seizure of related materials.
