Recent Case Law
- Study Permit – Purpose of Visit – Ekong v. Canada, 2025 FC 1355: Nigerian applicant’s study permit was refused for inconsistent temporary intent and lack of necessity for the chosen program. The Court found that the officer failed to consider pull factors, including family, businesses, and a stated return to a senior role with the current employer, and gave no rational explanation for discounting the evidence. Judicial review granted. Read more
- Open Work Permit – Adiele v. Canada, 2025 FC 1256: The applicant’s spousal open work permit to accompany a student was refused, first for lack of proof of the spouse’s full-time student status and later for insufficient funds. The Minister argued mootness due to reconsideration, but the Court found a live controversy remained and declined to dismiss. The Court held the initial decision was made without regard to the evidence. Judicial review granted. Read more
IRCC News Updates
- Public Consultations Open on 2026 Express Entry Economic Priorities: IRCC is seeking feedback from the public and stakeholders from August 6, 2025, to September 3, 2025, on economic priorities for category-based selection in Express Entry. Current categories include healthcare, trades, education, agriculture, STEM, and French-language proficiency, with a focus on addressing long-term labour shortages, supporting Francophone immigration outside Quebec, and transitioning temporary residents to permanent residence. A new priority under consideration is leadership and innovation to drive growth. Read more
