Recent Case Law
- Humanitarian & Compassionate: In Godday, 2023 FC 1360, which involved an applicant from Côte d’Ivoire claiming de facto statelessness, the Federal Court granted the judicial review of a denied application for permanent residence under subsection 25(1) of the IRPA. The Court determined that the Officer failed to adequately consider the applicant’s inability to secure essential Ivorian travel documents due to missing personal information. Read more
- C11 Work Permit – International Mobility Program: In Jamali, 2023 FC 1328, the Federal Court dismissed the judicial review of an Iranian applicant’s denial for a C11 work permit under paragraph 205(a) of the IRPR. The Officer deemed the applicant’s business plan as speculative and non-compliant with the Labour Market Impact Assessment (LMIA) exemption prerequisites. Read more
Program Delivery Updates
- Family Class Fee Exemption for Sudanese Departures: On October 12, 2023, IRCC updated its Program Delivery Instructions to include a fee exemption code for permanent residence applications under the family class. This update aims to support immediate family members of Canadian citizens and Canadian permanent residents who have departed Sudan. Read more
- Study Permits for Armed Forces: On October 10, 2023, IRCC updated the Program Delivery Instructions for study permits. The section related to armed forces was revised to reflect changes in how the Department of National Defence supports incoming military personnel for training purposes. Read more
IRCC News Updates
- Canada’s Support for Migrants in the Americas: On October 10, 2023, Minister Marc Miller announced plans to welcome 15,000 humanitarian migrants. This includes 11,000 individuals from Colombia, Haiti, and Venezuela through a new permanent residence pathway. Eligibility criteria extend to those with family ties in Canada. Additionally, 4,000 temporary foreign workers will be admitted. Read more
- Parents and Grandparents Program: Starting October 10, 2023, IRCC will begin sending email invitations to apply for the PGP to potential sponsors who completed an Interest to Sponsor form in 2020. These invitations will be randomly selected and sent over a two-week period. Read more
